PART 1: WAIVER AND RELEASE OF LIABILITY

I, the undersigned participant, or the parent/legal guardian of the minor participant named above, hereby acknowledge and agree to the following terms:

Acknowledgment of Risks: I understand that Brazilian Jiu-Jitsu (BJJ), martial arts, and any related physical activities involve inherent risks of physical injury, including but not limited to, sprains, fractures, dislocations, bruises, concussions, and, in rare cases, more severe injuries or even death. I understand these risks are present regardless of the skill level of the participants or the supervision provided.
Assumption of Risk: I voluntarily assume all risks associated with my participation in all BJJ classes, open mats, training sessions, and any other activities at Sceptre Jiu Jitsu. My participation is completely voluntary and is done at my own risk.
Release of Liability: I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, and forever discharge Sceptre Jiu Jitsu, its owners, instructors, employees, agents, and affiliates (collectively, "the Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or any property belonging to me, while participating in any activity or using any facility at Sceptre Jiu Jitsu. This release includes any claims based on the negligence of the Released Parties.
Medical Condition: I certify that I am in good physical condition and have no medical conditions that would prevent me from participating in BJJ activities. I agree to inform a staff member immediately if I feel unwell or sustain any injury during training.
Indemnification: I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including reasonable attorneys' fees, that they may incur due to my participation, whether caused by my negligence or otherwise.

PART 2: PHOTO AND VIDEO USAGE POLICY

I, the undersigned participant, or the parent/legal guardian of the minor participant named above, hereby grant Sceptre Jiu Jitsu permission to use my (or my child’s) likeness in photographs, videos, and other media as described below:

Grant of Rights: I grant Sceptre Jiu Jitsu and its employees, agents, and representatives the right to take photographs, video recordings, and other forms of media of me (or my child) during classes, events, and other activities at the school. This includes the use of security cameras for safety and security purposes.
Permitted Use: I authorize the Released Parties to use these photographs and video recordings in any and all of their publications, including but not limited to, social media platforms (such as Facebook, Instagram, YouTube), websites, brochures, advertisements, and other promotional materials, without compensation or further notice.
Purpose: I understand that the purpose of this media is for marketing, promotion, and documentation of the school's activities. The images and videos may be used to showcase techniques, share class experiences, and promote the benefits of BJJ.
No Guarantee of Use: I understand that this release does not obligate Sceptre Jiu Jitsu to use my (or my child’s) image or likeness in any way.
Revocation: I understand that I have the right to revoke this photo/video release by providing a written request to Sceptre Jiu Jitsu. This revocation will apply to future media use but will not affect any materials already in circulation or produced prior to the date of the revocation.

Photo/Video Usage Opt-Out

- I acknowledge the photo and video policy above, but I prefer to have my photos and videos NOT used for any marketing or social media purposes (e.g., website, Instagram, Facebook). I understand that this does not apply to security cameras used for safety purposes. If this box is checked we will make our best efforts to avoid usage of your image.

PART 3: ACKNOWLEDGMENT

- I acknowledge and certify that I have read and fully understand this entire document, including the waiver and release of liability and the photo/video usage policy. I am signing this agreement voluntarily and intend for it to be a complete and unconditional release of all liability to the greatest extent allowed by law

By enrolling in a membership with Sceptre Jiu Jitsu ("The Gym"), you agree to the following terms and conditions.

1. Membership Billing and Payments

Billing Date: All recurring membership fees will be charged on the 15th day of each month for the upcoming month of training.
Membership Fee: You will be billed the agreed-upon monthly membership price for your chosen plan on the Billing Date.
Payment Method: All members must maintain a valid credit card or banking information on file for automatic monthly billing.
Late/Failed Payments: If a payment fails, The Gym reserves the right to charge a late fee and/or suspend your access to training until the outstanding balance is paid in full.
Check In / Class Packages: If you utilize a 10 class pack it is your responsibility to check in at the front desk or via the mobile app for every session. for yourself or your child
- Each class counts as 1 session
- Open Mat does NOT count as a session
- If you repeatedly miss check in we will ask you to switch to an Unlimited Membership.

2. Membership Hold/Pause Policy

Requesting a Hold: Members may request to place their membership on hold (pause billing) for a specified period due to injury, travel, or other temporary reasons.
Hold Notification Deadline: To pause your billing for the upcoming month, you must submit a hold request at least seven (7) days prior to the 15th of the month (i.e., by the 8th of the month).
Late Hold Requests: Requests received after this deadline cannot guarantee that the upcoming monthly payment will not be charged. In the event of a charge, The Gym will work directly with the member to resolve the payment.
Hold Limits and Pricing:
- Members are permitted to utilize the membership pause feature a maximum of two (2) times per calendar year while maintaining their current membership pricing structure.
- If a member requests to pause their membership more than two (2) times within a calendar year, upon reinstatement, their membership will be upgraded to our latest membership pricing, along with any applicable discounts they qualify for at that time.
Understand Pausing: You pay on the 15th of the month for 30 days of training. If you pause on the 8th, you may train up to the 15th of that month.
- You will not be able to train until the 15th of the next month.
- If you want to return to training prior to the 15th, you will be charged a prorated amount of $50 for each week prior to the 15th.

3. Membership Cancellation Policy

Cancellation Requirement: To cancel your membership, you must submit a formal request via email to info@sceptrejiujitsu.com or in person with a member of The Gym management.
Cancellation Notice: Cancellations must be requested before the 15th of the month. If the cancellation request is received on or after the 15th, you will be billed for that month, and your membership will terminate at the end of that billing cycle.
Refunds: Membership fees are non-refundable. We will do our best to work out situations related to cancellation and pauses so that both parties are treated fairly.

4. Termination of Membership by The Gym

Right to Terminate: Sceptre Jiu Jitsu reserves the right to terminate a membership for any reason The Gym deems necessary, including but not limited to:
- Violation of gym rules, code of conduct, or safety policies.
- Repeated failure to make timely payments.
- Any behavior that, in the sole judgment of The Gym management, is disruptive, unsafe, or harmful to other members or staff.
Effect of Termination: If The Gym terminates a membership, the member will be notified, and access to The Gym facilities will cease immediately. Any outstanding fees must still be paid.
